
The NSW regulations governing retail leases and implementation of the National Code of Conduct for commercial/retail leases such as temporary protections against lock-out and terminations will cease on 13 January 2022. This means that if you wish to pursue a reduction in rent or other lease conditions and you have not yet provided the relevant information to your landlord showing you are, or were an ‘impacted lessee’ (evidence of a NSW business grant or JobSaver assistance, your turnover is less than $50m and a decline in sales of at least 30%) during some part of the pandemic period, your landlord may assume you do not require the “rent and other terms” to be renegotiated.
