Can an employee under the age of 18 sell tobacco or e-cigarette products?

Following on from the attempt by NSW Lotteries and Tabcorp to restrict the age of staff who can sell lottery products, NANA has received a considerable number of enquiries about any age restrictions which may apply to selling tobacco or e-cigarette products.  
In NSW there is no restriction on the age of a an employee who may sell tobacco and e-cigarette products, however it is an employer’s responsibility to ensure all employees are fully aware of the law related to selling tobacco and e-cigarette products as well as the consequences that may arise if this law is broken.
Similarly, there are no age restrictions on employees who are able to sell tobacco and e-cigarette products in the ACT.
